【裁判摘要】

在申请变更监护人、变更抚养关系等需要确认未成年人、无行为能力或者限制行为能力人的财产监管责任的案件中，如监护人因年龄、身体健康等原因导致财产监管能力不足，或者监护人与被监护人的财产利益存在冲突等情况，造成监护人无法有效管理被监护人财产，可能造成其财产利益受损的，为体现“最有利于被监护人”的法律原则，经监护人与第三方协商一致并听取被监护人意见，经法院审查认定，可将被监护人财产委托第三方监管。

[Judgment Abstract]

In cases where an application is filed for adjusting the guardian or child custody and it is necessary to confirm the property supervision and management duties of a minor, a person without capacity of conduct, or a person with limited capacity of conduct, if the guardian has poor capability of property supervision and management due to age, physical health, and other reasons or there are conflicts between the guardian and the ward in property interests, causing the guardian’s failure to effectively manage the property of the ward and possibly causing damage to the ward’s property interests, for the purpose of demonstrating the legal principle of “most benefiting the ward,” upon consultation between the guardian and a third party and listening to opinions of the ward, a third party may be entrusted with supervising and managing the ward’s property upon examination and recognition of the people’s court.

承包人出具虚假的工程款收款证明，就其未获清偿的工程款债权主张享有建设工程价款优先受偿权的，人民法院不予支持。

[Judgment Abstract]

Where the contractor issues false certificates on receipt of project funds and claims priority of compensation from the construction project price for its creditor’s right against the project fund that has not been repaid, the people’s court shall not support such claim.

滥伐林木类案件中，被告人认罪认罚，积极缴纳补植复绿保证金，并承诺按受损林木倍数补种树木用于生态修复的，可对其从轻处罚。

In a case involving deforesting, where defendant admits guilt and accepts punishment, proactively pays the deposit for replantation, and promises to replant trees of specific times the damaged forest trees for ecological restoration, he or she may be given a lighter punishment.
