Alert! Work Permit Extension Will Be Rejected For This Reason!

Recently some of HACOS's clients tell us that they didn't pass the visa extension application and don't know why. What's wrong? 



Many foreigners in China may not care about the tax situation of the companies they work for, or not be aware of the importance of social security insurance


However, these are the key factors that affect your work and residence permit extension! 


MUSTAFA, one of our Iraqi clients, owns a company in China to do business. He went to the Exit & Entry Administration Department to apply for a residence extension. 



The officials asked for the proof of the company's social insurance contributions for employees but he failed to offer. He didn't pay social security insurance for his employees since his company has high mobility of employees that they left on the probation. 


As a result, he got a 3-month visa and had to supplement the relevant payment proof to apply for the extension.

According to Social Insurance Law of the People's Republic of China, the employer shall bear the responsibility of paying for the period of time, payment of late fee and fine due to non-payment of social security for expatriate employees. 




Entities and individuals within the territory of the People's Republic of China shall pay social insurance premiums in accordance with the law and shall be entitled to enquiry about payment records and personal interest records and request social insurance agencies to provide relevant services such as social insurance consultation. 


At present, the system between various departments in China is continuously interconnected, the data of the enterprise will be shared with different departments. 


So the Immigration Department has the opportunity to request the foreigner’s social security record when the foreigner handles the work visa related matters. 



REMINDER

When applying for a work permit extension, employers of the companies founded more than one year are required to offer: 

  • The proof of tax payment for one year, and 
  • The proof of social insurance payment for half a year. 


If the tax payment is less than 5,000 yuan or no record of social insurance payment can be offered, employers would probably get visa for only 3 months


In order to ensure the successful application for your visa extension, we advise that the company: 


  • Pays taxes (Enterprise Income Tax or Value-added Tax) more than 5,000 yuan each year, and 
  • Pays social insurance for at least one employee
