Don't Worry! China Extends 2-Month Stay Duration Automatically!

Good news! During the epidemic prevention and control period, the visa expiry date for foreigners in China will be automatically postponed for two months. Meanwhile, China has rolled a series of measures to offer exit and entry conveniences to foreigners! 


2-MONTH VISA EXTENSIONS


According to the Press Conference of the Joint Prevention and Control Mechanism of the State Council, foreigners in China can extend their stays by up to two months during the epidemic. 



The extension will be handled automatically, which means that if your visa expires, you can still legally stay in China or leave the country with no need of a separate application



For Chinese and foreigners involved in epidemic prevention such as medical assistance, drug development and academic exchange, local authorities will issue urgent exit and entry permits within 24 fours for them. 


They could also apply for a special visa at Chinese ports of entry if their journey is made on too short a notice. 


Like Chinese citizens, foreign residents in China can file applications online and have documents delivered to their homes after the issuance. 



10 EXIT-ENTRY MEASURES


During the epidemic prevention and control period, the exit and entry administration department across China continues to provide visa extension, stay permit and residence permit processing service to foreigners, so as to guarantee their lawful stay and residence in China. 


In order to curb the virus spread and support work resumption, National Immigration Administration (NIA) has recently introduced 10 measures including reopening exit-entry service windows and providing facilitation



  • Reopen the exit-entry service windows in an orderly manner
  • Extend the duration of stay and residence of some foreigners in China
  • Handle re-entry visas for foreigners in China in advance
  • Handle port visas for foreigners coming to China for investment, business start-up and trade
  • Provide exit and entry facilities for Chinese and foreigners involved in the epidemic prevention and control
  • Provide online services to handle exit and entry documents for Chinese and foreigners
  • Give priority to exit-entry documents application of the personnel returning to work and production
  • Give priority to quick clearance of import and export goods
  • Provide exit-entry policy changes inquiry services
  • Strengthen prevention at exit-entry windows and customs clearance sites

PERMANENT RESIDENCE RULES

The Ministry of Justice on Thursday published draft rules on foreigners' permanent residence in order to solicit public opinion. 

The draft rules are meant to further the country's opening up to the world, standardize the administration of foreigners' permanent residence in China and protect the legal rights of aliens who have obtained permanent residence. 


According to the draft rules, these foreigners can apply for permanent residence: 

  • Foreigners with internationally acknowledged achievements in the fields of economics, science and technology, education, culture, health and sports will be able to apply for permanent residence. 
  • Foreigners who have made outstanding contributions to China's economic and social development, including engaging in public welfare activities and promoting exchanges between China and other countries, can apply upon the recommendations of relevant national departments or provincial-level governments. 
  • Talented foreigners in urgent demand in some industries or regions of the country who are recommended by relevant authorities-including university professors and senior managers in high-end enterprises-may apply for permanent residence. 
  • Foreigners whose investment in China is at least 10 million yuan ($1.42 million) or who invest in an area under the country's encouragement measures with the amount of investment, tax payments and the number of Chinese citizens employed meeting prescribed standards, are eligible to apply.

Eligible applicants also include spouses of Chinese citizens. 

The draft rules added a new section regarding conditions under which foreign employees in China can apply for permanent residence, including foreigners with doctoral degrees or diplomas from an internationally renowned university who have worked in China for at least three years and have resided in China for at least a year

The draft rules require permanent foreign residents to live in China for at least three months each year


The draft rules have raised a huge discussion since it is published. 

China permanent residence approval has been known for being very strict. Many foreigners even sigh that it is impossible to apply for a Chinese green card. 

Some people may think that the rules will lower the barrier, and worry that some illegal immigrants will likely take advantage of the rules to get the legal status of permanent residents as there are reportedly some illegal immigrants who have stayed in China for years. 



As we said above, however, it is clear that China has always encouraged and attracted talents to come to the country. The rules underline the eligible applicants need to have made contributions or acknowledged achievements.
